Common use of Improvements to be Constructed Clause in Contracts

Improvements to be Constructed. The Entity represents that, subject to the satisfaction of all Project Contingencies as provided in the Redevelopment Agreement, it will acquire and construct or cause to be constructed the Project in accordance with the Redevelopment Agreement and the Redevelopment Plan, the use of which Project is more specifically described in the Exemption Application.

Improvements to be Constructed. The Entity represents that, subject to the satisfaction of all Project Contingencies as provided in the Redevelopment Agreement, that it will acquire and construct or cause the Improvements to be constructed the Project in accordance with the Redevelopment Agreement and the Redevelopment Plan, the use of which Project is more specifically described in approved site plan, the Exemption ApplicationRedevelopment Agreement, and the Borough’s Master Plan.
