Imputable Knowledge. To the extent Seller makes representations and warranties in this Agreement "to the best of Seller's knowledge" or in a similarly qualified manner, there is agreement between the Parties that knowledge of Mr. Jurgen Beissel, managing director (GESCHAFTSFUHRER) of Target as ox xxx Xxxxxxx Xxxx, is imputable to Seller and, for purposes of Section 4.2.2, the knowledge that Mr. Jurgen Beissel would have upon an inquiry into the relevant matter xxxx x xxxxxxx xxrson holding his position would have made is also imputable to Seller.
