Common use of In cases where a Third Party Agreement Clause in Contracts

In cases where a Third Party Agreement. does not graAnTt &T the right to provide access and use rights to others as contemplated in Section 3.4.2 above anAdT&T, despite its best efforts, is unable to secure such access and use rights for CLEC in accordance with Section 3.4.3 above, or, in the case where CLEC elects not to invoke its rights under Section 3.4.2 above or Section 3.4.3 above, CLEC shall be responsible for obtaining such permission to access and use such ROWAT. &T shall cooperate with CLEC in obtaining such permission and shall not prevent or delay any Third Party assignment of ROWs to CLEC.
