Inapplicability of Subsequent Legislation. Except for any referendum of the Adopting Ordinance, if an ordinance, resolution or other measure is enacted, whether by action of the Board, by voter initiative, or otherwise, that would prevent the development of the Property consistent with the Approvals and this Agreement, including moratoria, County herein agrees that such ordinance, resolution or other measures shall not apply to the Property or limit the development of the Property as set forth in this Agreement and in the Approvals.

  • Merger Clause This Agreement, including the Exhibits attached hereto and incorporated herein by reference, constitutes the sole Agreement of the parties hereto and correctly states the rights, duties, and obligations of each party as of this document's date. A State Mortgage Regulator may sua sponte issue such subsequent order without the review and approval of Respondent provided the subsequent order does not amend, alter, or otherwise change the terms of the Agreement.
