INCLUSIONS AND EXCLUSIONS. After you file a petition seeking an election, the Regional Director may direct the agency or activity to provide the Re- gional Director and all parties affected by issues raised in the petition with a current alphabetized list of employees and job classifications included in and/ or excluded from the existing or claimed unit affected by issues raised in the petition.

In the event that SERB rules any of these positions should be included in another bargaining unit that position will be removed from the bargaining unit immediately. The recognition is for the purpose of discussing with the Board or its representative matters as designated herein.
INCLUSIONS AND EXCLUSIONS. 5.1 The following Support Case types are INCLUDED in the Support described in this Appendix (“Support”):
5.1.1 “Break Fix Support”.
a) Emergency support inquiries for system-down or critical problem diagnosis and resolution;
b) Correcting errors or other problems in the Products in an appropriate time, or issuing instructions to Client’s designated contacts as to how to resolve the problem in order to resume operation of the Products to operate in a manner reasonably satisfactory to Client until the problem can be fully corrected by PA.
5.1.2 “How-To Support” questions regarding user or administration application functionality and usability. Examples include: where to find features, minor task instruction, and functionality clarification.
5.2 The following list of activities, which is not exhaustive, are EXCLUDED from the scope of Support:
5.2.1 Support for Customisations developed by PA.
5.2.2 Problems arising from Client performed installations or upgrades where PA did not sign- off on the installation or upgrade.
a) PA will not provide Support for Products implemented or upgraded without the assistance of PA b) PA Professional Services may be engaged by Client to participate in any resulting clean-up activities arising.
5.2.3 Problems arising from data imports or data conversions.
INCLUSIONS AND EXCLUSIONS. Employees in Supervisory or other exempt positions and those in the unit represented by OAPSE Local #102 are excluded from the bargaining unit.

For all milestones except the “Pre-Signing” and “Analytical Toolkit” milestones, any project activities involving the design of improved formulations prepared by MSX shall include stability analyses performed on sample materials front sample batches and formulations at the following time periods: [***]. The costs of the performance of stability analyses at these intervals are covered and included in the applicable milestone payment, and no additional payments by RB for these stability analyses shall be required. If, however, RB requests stability analyses at time intervals beyond those specified in the previous sentence, additional reasonable charges for the cost of performing the additional requested stability analyses would apply. Capital purchases required for final solutions (e.g., “[***]”) are not included in the milestone payments, and would be an additional charge. If purchased by MSX, the costs of such capital purchases would be passed through (without markup) to RB. Except as expressly stated in this Section 4.5 (regarding extra stability tests, capital purchases for [***]) or in Section 4.4 (regarding termination fees), the milestone payments specified for each activity shall be all-inclusive for all project activities pertaining to a particular milestone to be completed. Work outside the scope of such project activities, and the additional fees associated therewith, would require a separate written agreement by both parties.

The Board of Education hereby recognizes the Association as the sole and exclusive bargaining agent for all bus drivers, special education drivers, all paraprofessionals working in special education, child care workers, bus paraprofessionals, playground, classroom, reading, library paraprofessionals in the secondary and elementary schools and office paraprofessionals, computer room paraprofessionals, library assistants full-time and part-time and custodial employees (including cleaners and grounds employees), mechanics, maintenance employees, laundry and cafeteria workers, bus washer, crossing guards, hall monitors and for all personnel engaged in secretarial and clerical work, full-time and part-time.
2. The following employees shall be excluded: CTEA, high school and middle school study hall supervisors, special personnel, substitutes, supervisors, and all other employees including all central office staff.
3. Paraprofessionals are defined as those paraprofessionals hired to work with and/or for certified personnel in a classroom or other assignments. Assignments may include regular or special classrooms, library, reading, playground or other duties as assigned by the Administration.
