Common use of Incomplete Insurance Clause in Contracts

Incomplete Insurance. In the event MBI is unable to obtain the insurance coverage required by this Article, or if any portion of MBI Insurance or other required coverage is cancelled and not immediately replaced, MBI shall promptly inform UHN and UHN may at its sole option maintain such insurance as it reasonably considers necessary, at the expense of MBI. If UHN is unable or unwilling to secure such insurance as it reasonably considers necessary and MBI continues to use the Additional Licensed Technology in humans, then UHN shall be free to terminate this Agreement in accordance with Section 7.2(b) hereof.
