Incorporated Instruments. The Restructuring Term Sheet, the Interim Financing Order, and the DIP Credit Agreement (as such documents, including all exhibits and annexes thereto, may be amended or modified in accordance with Section 7 hereof) are expressly incorporated by reference herein and made a part of this Agreement as if fully set forth herein.
