Incorporation of BRCP. The BRCP and each of its provisions are intended to be, and by this reference are, incorporated herein. This Agreement is intended to specify the obligations of the Parties under the BRCP, recognizing that the BRCP is a conservation plan and was not drafted as a contract. In the event of any direct contradiction, conflict or inconsistency between this Agreement and the BRCP, the terms of this Agreement will control. In all other cases, the provisions of this Agreement and the BRCP will be interpreted to be consistent with and complementary to each other.

Incorporation of BRCP. The BRCP and each of its provisions are intended to be, and by this reference are, incorporated herein. Notwithstanding such incorporation, the Parties recognize that the BRCP was drafted by the Permittees and submitted to the Wildlife Agencies to support their applications for Permits. Characterizations, analyses, and representations in the BRCP, in particular, those regarding Federal or State laws, regulations, policies, and guidance represent the views of the Permittees and shall not control the administration of the Permits by the Wildlife Agencies in accordance with Federal and State laws, regulations, policies, and guidance. In the event of any direct contradiction, conflict or inconsistency between the Permits, the BRCP, or this Agreement, the terms of the Permits shall control. Each Party acknowledges that no representation, inducement, promise or agreement, oral or otherwise, has been made by the other Party or anyone acting on behalf of the other Party that is not embodied in the Permits, BRCP, or this Agreement.

  • Incorporation of terms The parties to the Trust Agreement will enter into the Trust Agreement by executing the Omnibus Instrument. The contractor will take action with respect to any subcontract or procurement as the sponsor or the Federal Aviation Administration may direct as a means of enforcing such provisions including sanctions for noncompliance. Provided, that if the contractor becomes involved in, or is threatened with litigation by a subcontractor, or supplier because of such direction, the contractor may request the sponsor to enter into any litigation to protect the interests of the sponsor. In addition, the contractor may request the United States to enter into the litigation to protect the interests of the United States.

  • Incorporation All Exhibits attached hereto and referred to herein are hereby incorporated herein and made a part hereof for all purposes as if fully set forth herein.

  • Incorporation of Documents The documents listed below in this Section IID are hereby incorporated by reference and fully made a part of the Contract. The Allottee shall pay the necessary subscription and/or membership amounts, together with the proportionate costs and expenses for (i) formation of the Association, and (ii) transfer of the Common Areas to the Association, including but not limited to stamp duty and registration costs, if any. The Allottee hereby authorizes the Promoter to take all necessary steps in this connection on his/her/their/its behalf, and further the Allottee shall comply with and/or adhere to all the Applicable Laws and all the rules, regulations, guidelines, etc. formulated from time to time by the Association.
