Incorporation of the Agreement. The terms and conditions of the Agreement are hereby incorporated in this Amendment as if fully set forth herein except as modified in this Amendment. All capitalized terms used in this Amendment but not defined herein shall have the meaning ascribed to them in the Agreement. The Transfer Agent and WFFM agree that for purposes of this Amendment, WFFM shall be deemed to have executed the Agreement in place of the Trusts and to have accepted the terms thereof, and the Transfer Agent further agrees that WFFM and not the Trusts shall be solely responsible under this Amendment. To the extent of any conflict between the Agreement, Addendum 1 and this Amendment, this Amendment shall control.
