16.3 The restriction set out in Clause 16.2 above does not apply to (a) applying a ValueMax fee in accordance with Clause 10.4; or (b) a variation in any fees, charges or interest that may be applied by us on default. We can vary such fees, charges or interest without obtaining your consent, especially all the fees mentioned in Clause 11.
16.4 If we vary this Agreement and the variation is to your disadvantage, we will give you at least 30 days’ prior written notice of the variation, except where we have to vary the Agreement more quickly to comply with legislation.

Variation of the Agreement. Initial Teacher Education provision is subject to external requirements set by external bodies, i.e. Ofsted, the Department for Education or any other body which may succeed them. Changes in policy and/or requirements by those bodies may result in changes to Initial Teacher Education provision. The University reserves the right to make amendments to the content of this agreement which may be required as a result of changes in policy and/or requirements from Ofsted, the Department for Education or any other body which may succeed them. The employer and employees acknowledge that circumstances may arise during the term of this agreement that warrant variation of this Agreement with respect to either all employees or any number of employees covered by this Agreement. Variation of the Agreement. 2.1 The parties accept that circumstances may arise during the term of this Collective Agreement that warrants variation of this Collective Agreement.
2.2 With respect to Section 54 of the Employment Relations Xxx 0000 the parties have agreed that this Collective Agreement may be varied during its term by agreement.
2.3 Where a party proposes any variation, a written proposal shall be forwarded to the other party. Such a proposal shall outline the variation sought, the reasons for the variation and the likely effect of the variation.
2.4 Any variation agreed to shall be recorded in writing and signed by the parties.
Variation of the Agreement. Except as permitted under this Agreement, the Agreement or a Service Order may only be varied by written agreement.
