Incumbent Rights/Reclassification. 11 19.3.1 When all of the positions in a class are reclassified to a higher 12 class, the incumbents of the positions who have been in the class for two (2) or 13 more years may be reclassified with their positions by the Personnel Commission. 14 When a portion of the positions within a class are reclassified to a higher class, an 15 incumbent, who has a continuous employment record of two (2) or more years in 16 one or more of the positions being reclassified, may be reclassified with his/her 17 position as provided by Personnel Commission rule. 18 19.3.2 In any reclassification that results in the displacement of a unit 20 position of equal time in the class. If a vacant permanent position of equal time is 21 not available, the incumbent unit member may bump the least senior person in the 22 class with the same number of hours, or if none, with the next existing greater 23 number of hours, or if none, the least senior unit member with the next existing 24 fewer number of hours in the class. 25 19.3.3 The basis for reclassification of the position must be a gradual 26 accretion of duties and not a sudden change occasioned by the reorganization or 27 the assignment of completely new duties and responsibilities. Determinations as 28 to gradual accretion will be on the basis of guidelines provided by the Personnel 29 Commission rules.
