Indemnity Insurance. 27.1 The employer agrees to indemnify employees for legal liability for costs and expenses, including legal representation where required, in respect of claims, actions or proceedings brought against the employer and/or employees arising in respect of any: − Negligent act, or − Error, or − Omission Whilst acting in the course of employment. 27.2 Employees will not be covered where such claim, action or proceeding: − arises from any wilful or deliberate act, or − is restricted solely to any disciplinary proceedings being taken by the governing registration body and/or professional association, or − relates to activities undertaken by the employee that are outside the scope of the employment agreement with the employer, or − relates to activities undertaken by the employee that are outside the scope of practice or the employees position and/or profession. 27.3 Provided that any such reasonable costs or expenses are first discussed with the employer before they are incurred.
