Common use of Indirect Damages Exclusion Clause in Contracts

Indirect Damages Exclusion. In no event will either party be liable for any special, punitive, exemplary, indirect, incidental, cover or consequential damages, or for lost data, lost profits, or damages related to business interruption, even if the party knew or should have known of the possibility of such damages, arising out of or relating to this Agreement. The foregoing disclaimer will not apply to the extent prohibited by law.
