Trial Services. If a trial period is indicated on an Order Form, Smarsh will provide Client with a temporary account to one or more Services (“Trial Account”). The Trial Account will be accessible beginning on the Activation Date (as defined in Section 7) and for the trial period set forth in the Order Form, or if no trial period is stated, the Trial Account period will be thirty (30) days from the Activation Date. DURING THE TRIAL PERIOD, THE TRIAL ACCOUNT AND ASSOCIATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” AND WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND.

Trial Services. If You are provided any Online Service for trial purposes, the trial period will commence on the date that You are notified by Accenture that the Online Service(s) has been provisioned and will continue for the time specified by Accenture, but not to exceed sixty (60) days. At any time prior to the commencement of the trial period or during the trial period, Accenture may, in its sole discretion, decline or discontinue provision of the Online Service(s) and terminate the trial with immediate effect. Once the trial period has commenced, You may terminate the trial and Accenture’s provision of the Online Service upon three (3) calendar days’ prior written notice to Accenture. After the trial period expires, You may request to continue using the Online Service(s) only upon purchase of a Subscription via an Order Confirmation. During the trial period the Online Service is provided “AS IS” and technical support is not included. All other terms and conditions of this Agreement shall otherwise apply.
Trial Services. Jitterbit may from time to time, permit Client to register for a free trial of certain Jitterbit Applications at xxxx://xxx.xxxxxxxxx.xxx (“Trial Services”). Trial Services will terminate on the earlier of: (i) the end of the free trial period for which Client registered; (ii) the start date of the Subscription Term for purchased Jitterbit Applications previously made available as Trial Services.
Trial Services. 3.1 If Customer is using a free trial, a proof of concept version of the Software, a beta version of the Software, or using the Software on any other free-of-charge basis as specified in an Order including any related support services to the extent provided by Company in its sole discretion (collectively, “Trial Services”), Company makes such Trial Services available to Customer until the earlier of: (i) the end of the free trial or proof of concept period or beta testing period as communicated by Company or specified in an Order; (ii) the start date of any purchased version of such Software; or (iii) written notice of termination from Company (“Trial Services Period”). 3.2 Company grants Customer, during the Trial Services Period, a non-exclusive, non-transferable right to access and use the Trial Services for Customer’s internal evaluation purposes in accordance with the Documentation and subject to the access and use restrictions set forth in this Agreement. Customer is authorized to use Trial Services only for evaluation and not for any business or productive purposes, unless otherwise authorized by Company in writing. 3.3 Any data Customer enters into the Trial Services and any configurations made to the Trial Services by or for Customer during the term of such Trial Services will be permanently lost unless Customer: (a) has purchased a subscription to the same Software as covered by the Trial Services; or (b) exports such data or configurations before the end of such free period. 3.4 There is no guarantee that features or functions of the Trial Services will be available, or if available will be the same, in the general release version of the Software, and Customer should review the Software features and functions before making a purchase. Company will be under no obligation to provide Customer any maintenance or support services with respect to the Trial Services. 3.5 Notwithstanding anything to the contrary, Company provides the Trial Services “as is” and “as available” without any warranties or representations of any kind. To the extent permitted by law, Company disclaims all implied warranties and representations, including, without limitation, any implied warranty of merchantability, fitness for a particular purpose and non- infringement. Trial Services. From time to time, we may offer you access to certain Service Offerings that we designate as “beta,” “evaluation,” or “trial” on the Predix Site or in Order Documents (“Trial Services”). Trial Services are provided to you free of charge, except as otherwise specified by us. We may limit, suspend, or terminate your access to any portion of the Trial Services for any reason, in our sole discretion, including, for example, the expiration of the Trial Services period, to enforce Trial Services usage limitations, or to protect our services or systems. Any product or service designated “beta” is subject to change without notice and may differ substantially upon commercial release. You acknowledge and understand that Trial Services may not have been tested or verified to meet security requirements, including the Data Protection Plan. Trial Services may not provide standard security features, like encryption, that are available in our other Service Offerings and may not be secure against cyber-attacks or other data breaches. Accordingly, you agree not to store any data that require confidential or secure treatment, including sensitive, regulatory or personal data. Trial Services may become unavailable or be taken offline at any time without notice and any data maintained in Trial Services environments may be deleted at any time, including at the end of the trial period. We are not responsible for any loss or compromise of data or breach of data security arising from your use of Trial Services. YOUR USE OF ANY TRIAL SERVICES IS AT YOUR SOLE RISK.
Trial Services. (a) If a free or paid for trial or evaluation of a Service (“Trial Service”) is available in the Third-Party Marketplace and approved by the Supplier, Customer may access and use the Trial Service for fourteen (14) days or such other duration specified by the Supplier (“Trial Service Term”). (b) Trial Services are provided for testing and evaluation solely for the Customer’s own internal information security purposes. (c) TRIAL SERVICES AND BETA SERVICES ARE PROVIDED “AS IS” WITHOUT ANY SUPPORT, INDEMNITY, LIABILITY OR REMEDY OF ANY KIND. TO THE EXTENT ALLOWED BY APPLICABLE LAW, SUPPLIER EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY, CONDITION, OR OTHER IMPLIED TERM AS TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON- INFRINGEMENT OF TRIAL SERVICES OR BETA SERVICES. (d) The terms of this Clause 2.7 apply, and prevail over any conflicting terms in this Agreement, with respect to all access and use of Trial Services.

Smarsh will not be responsible for any direct, indirect, consequential or any other damages, loss or claims resulting from Client’s access to, or use of the Trial Account or the Trial Account Services during the trial period.

Trial Services. Datasite may make beta services and related documentation (“Trial Services”) available to Customer. Trial Services are not considered “Services” under this Agreement and are provided “As Is” and without warranty of any kind, express or implied, however, all confidentiality and ownership rights, and Customer obligations concerning the Services and Content, shall apply equally to Customer’s use of Trial Services. Datasite may discontinue the Trial Services at any time in its sole discretion and may never make them generally available. Datasite will have no liability for any harm or damage arising out of or in connection with the Trial Services. The provision of any Trial Services to a Customer may be subject to additional terms and conditions.

In light of the fact that a Trial Service is provided free of charge, ProjectCompanion disclaims all warranties, representations, and liabilities as set forth in this contract and ProjectCompanion shall not be liable for damages of any kind related to the Client’s or User’s use of a Trial Service.
