Individual Enforcement Clause Samples
The Individual Enforcement clause establishes that any disputes or claims arising under the agreement must be resolved on an individual basis, rather than through collective or class actions. In practice, this means that each party must pursue their own claim separately and cannot join with others to file a lawsuit or arbitration as a group. This clause is designed to prevent class actions and collective proceedings, ensuring that disputes are handled individually, which can limit the legal exposure and potential liability of the party seeking to enforce the clause.
Individual Enforcement. Owner shall be entitled to enforce this Guaranty and to take any action with respect hereto without any requirement to join any party (other than Guarantor) in any such enforcement or other action.
Individual Enforcement. Notwithstanding the provisions of Section 6.3 of this Agreement or any provision of any other Ancillary Agreement (as defined in the Separation and Distribution Agreement) or the Merger Agreement, any individual who, immediately prior to the Distribution is a holder of an AT&T Option, a grant of AT&T restricted stock, restricted stock units, performance shares or stock units, shall have the right in his or her individual capacity to enforce the provisions of this Section 5.3, subject to the provisions of Section 5.5.
