Common use of Informal Resolution and Mediation of Contract Disputes Clause in Contracts

Informal Resolution and Mediation of Contract Disputes. Owner and Consultant agree to resolve all disputes, with the exception of any dispute initiated by a homeowner against Owner, Owner’s contractor or any subcontractor, Consultant, any Consultant Representative, or any other consultant, engineer, or other person under contract with Owner, and any dispute between Owner and Consultant or any Consultant Representative for amounts paid by Owner or any person affiliated with Owner to resolve a claim by a homeowner, in accordance with Section 21.8. These disputes as described in this Section 21.8 are referred to as “Contract Disputes”.
