Common use of Information Furnished by the Underwriter Clause in Contracts

Information Furnished by the Underwriter. The Company and the Operating Partnership acknowledge and agree that the statements set forth in the last paragraph on the cover page, the stabilization legend on the inside cover page and the statements in the first and third paragraphs under the caption "Underwriting" in any Prepricing Prospectus and in the Prospectus, constitute the only information furnished by or on behalf of the Underwriter as such information is referred to in Sections 5(b) and 6 hereof.
