Common use of Information Request Clause in Contracts

Information Request. If the Freight Customer considers that: (a) it requires information in relation to the Network from Network Rail, including information about the available capacity of the Network; (b) the information is not contained in the Operating Constraints and could not reasonably be derived from the Operating Constraints by the Freight Customer; and (c) the information is reasonably required in connection with an Access Proposal or Train Operator Variation Request it is considering making, the Freight Customer may serve a request on Network Rail for information (an "Information Request").
