Information to be Available to the Secretary. The Business Associate agrees that it will make its internal practices, books, and records relating to the use and disclosure of Protected Health Information received from, or created or received by the Business Associate on behalf of, the Covered Entity available to the Secretary of the Department of Health and Human Services solely for purposes of determining the Covered Entity’s compliance with HIPAA.

Information to be Available to the Secretary. Each Non-Covered Entity agrees that it will make its internal practices, books, and records relating to the Use and Disclosure of Protected Health Information received from, or created or received by such Non-Covered Entity on behalf of, the Covered Entities available to the Secretary of the Department of Health and Human Services for purposes of determining the Covered Entities' compliance with the Privacy Standards.
