Common use of Inktomi Obligations Clause in Contracts

Inktomi Obligations. Inktomi's sole obligation under the foregoing warranties is to use its reasonable best efforts to correct any portion of the Inktomi Technology or its business practices that does not meet the foregoing warranties within a reasonable period of time, and if Inktomi fails to do so, then Powerize shall have the right to immediately terminate this Agreement and receive as a sole remedy a refund of all amounts paid by Powerize applicable to Services to be rendered following the date of such termination.
