Nonexclusive Services. Client acknowledge that Consultant is currently providing services of the same or similar nature to other parties. Client agrees that Consultant is not barred from rendering services of the same or a similar nature to any other individual or entity.
Nonexclusive Services. Customer understands that Inktomi will provide the Services on a nonexclusive basis. Customer acknowledges that Inktomi has customized and provided, and will continue to customize and provide, its software and technology to other parties for use in connection with a variety of applications, including, without limitation, search engine, e-commerce and communication applications. Nothing in this Agreement will be deemed to limit or restrict Inktomi from customizing and providing its software and technology to other parties for any purpose or in any way affect the rights granted to such other parties. Further, nothing in this Agreement will be deemed to limit or restrict Customer's ability to acquire, license, independently develop, or serve for itself, or have others acquire, license, develop, or serve for Customer, similar services performing the same or similar functions as the Services contemplated by this Agreement, or to market and offer such similar services in addition to the Services contemplated by this Agreement.

Nonexclusive Services. This Agreement shall not be interpreted to prevent or preclude Consultant from rendering any services for Consultant’s own account or to any other person or entity as Consultant in its sole discretion shall determine. Consultant agrees that performing such services will not materially interfere with services to be performed for the Successor Agency.
Nonexclusive Services. Client acknowledges that DataSync has customized and provided, and will continue to customize and provide, software and technology to other parties for use in connection with a variety of applications and that some of these other parties may now or in the future be in direct or indirect competition with Client or Client’s clients. Nothing in this Agreement will be deemed to limit or restrict DataSync from customizing and providing its software and technology to other parties for any purpose, including using any of the intellectual property developed under this Agreement, or shall in any way affect the rights granted to such other parties. Premier Agent acknowledges that SAGE solicits and performs similar services on behalf of other financial professionals that the Premier Agent may consider direct or indirect competition.

Powerize acknowledges that Inktomi has customized and provided, and will continue to customize and provide, its software and technology to other parties for use in connection with a variety of applications, including search engine applications. Nothing in this Agreement will be deemed to limit or restrict Inktomi from customizing and providing its software and technology to other parties for any purpose, including in connection with search engine applications, or in any way affect the rights granted to such other parties. Inktomi reserves the right to notify other customers of the signing of this Agreement, but agrees not to provide such notice earlier than two weeks before a public announcement by Powerize of its business relationship with Inktomi or two weeks before commercial launch of its search service, whichever is later.
