Common use of Innovation Clause in Contracts

Innovation. Customer recognises that PCS always seeks to innovate and find ways to improve the Services with new features and functions. Customer agrees that PCS may therefore change the Services (i) without notice provided such changes do not materially adversely affect the nature or quality of the Services or (ii) on written notice to Customer where such changes will materially adversely affect the nature or quality of the Services, provided that Customer shall have the right to terminate the Agreement on giving written notice to Supplier not more than one (1) month following any such change taking effect. PCS will refund Customer any prepaid fees covering the remainder of the term of all Order Forms after the effective date of termination.
