Common use of INSPECTION AFTER DELIVERY Clause in Contracts

INSPECTION AFTER DELIVERY. 20.1 Unless otherwise agreed in the Contract, the Buyer shall inspect the goods or assess the services within a reasonable time of their being delivered or performed, respectively. If that inspection indicates that the goods or services are inconsistent with the Contract, then, at the Buyer’s discretion, the Buyer shall return the goods or reject the services or shall accept the goods or services at a lower price. 20.2 The inspection shall not preclude the Buyer from claiming the Seller’s non- performance of its warranty obligations stipulated in Article 12 or any other obligations the Seller may have to the Buyer.
