Common use of Inspection and cure Clause in Contracts

Inspection and cure. Not earlier than 90 (ninety) days before Termination but not later than 15 (fifteen) days before the effective date of such Termination, the Independent Monitor[s] shall verify, after giving due notice to the Concessionaire of the time, date and venue of such verification, compliance by the Concessionaire with the Safety Requirements, Service Requirements and Maintenance Requirements, and if required, cause appropriate tests to be carried out at the Concessionaire‟s cost for this purpose. Defaults, if any, in the Safety Requirements, Service Requirements and Maintenance Requirements shall be cured by the Concessionaire at its cost and the provisions of Article 35 shall apply, mutatis mutandis, in relation to curing of defects or deficiencies under this Article 34.
