Common use of INSPECTION AND EXPEDITING Clause in Contracts

INSPECTION AND EXPEDITING. Contractor shall perform all inspection, expediting, quality surveillance and traffic services as are required for performance of the Services. Contractor shall perform such detailed inspection of all work in progress at intervals appropriate to the stage of construction or fabrication of the Facility Site as is necessary to ensure that such work is proceeding in accordance with this Agreement and the Design Documents and to protect Owner against defects and deficiencies in such work. On the basis of such inspections, Contractor shall keep Owner informed of the progress and quality of all work and shall provide Owner with written reports of deficiencies revealed through such inspections and of measures proposed by Contractor to remedy such deficiencies. Owner and Owner's designee(s) shall be given at least five (5) days' advance notice of, and shall have the option of being present at, all inspections and witness points off the Facility Site to be specified in the Quality Assurance Plan, and, in the event that the progress and quality of the work is not proceeding in accordance with this Agreement and the Design Documents, shall be entitled to make recommendations to Contractor for the purpose of remedying such deficiencies. In the event that Owner or Owner's designee(s) fails to be present for such inspection or witness point on the date scheduled therefor, Contractor may proceed with such inspection or witness point in Owner's or Owner's designee(s)'s absence. No inspection performed or failed to be performed by Owner or Owner's designee(s) hereunder shall be construed as a waiver of any of Contractor's obligations hereunder or be construed as an approval or acceptance of any of the Services. In addition, Contractor shall secure for Owner and its designees the inspection rights set forth in Section 2.1.13 hereof.

Contractor shall perform all inspection, expediting, quality surveillance and maintenance of traffic services as that are required for performance of the ServicesWork on a timely basis. Contractor’s responsibilities under this Section 2.1.9 shall include, without limitation, inspecting all materials and equipment, including the ETTM System, both on and off the Project Right of Way that comprise or will comprise the Project or that are to be used in performance of the Work hereunder. Contractor shall perform such a detailed inspection of all work Work in progress at intervals appropriate to the stage of construction or fabrication off the Project Right of the Facility Site Way as is necessary to ensure that such work Work is proceeding in accordance with this Agreement and the Design Contract Documents and to protect Owner Concessionaire against defects and deficiencies in such workWork. On the basis of such inspections, Contractor shall keep Owner Concessionaire continuously informed of the progress and quality of all work Work and shall provide Owner Concessionaire with written reports of deficiencies revealed through such inspections and of measures proposed by Contractor to remedy such deficiencies. Owner Contractor shall use all reasonable efforts to secure for Concessionaire, VDOT and Owner's designee(s) shall be given at least five (5) days' advance notice of, and shall have the Independent Engineer or their representatives the option of being present at, at all inspections and witness points off the Facility Site to be specified in the Quality Assurance Plan, and, in Project Right of Way. In the event that the progress and quality of the work Work is not proceeding in accordance with this Agreement and the Design Contract Documents, Concessionaire shall be entitled to make recommendations to Contractor for the purpose of remedying such deficiencies. In Contractor shall provide Concessionaire with a detailed list of materials and equipment inspection points. Contractor shall provide Concessionaire and VDOT with at least five (5) days’ prior written notice of all inspections and on a monthly basis, Contractor shall advise Concessionaire and VDOT of inspections planned for the event that Owner or Owner's designee(s) fails forthcoming month. Concessionaire, VDOT and the Independent Engineer, and each of their designated representatives, shall have the right to be present for such inspection at and participate in all inspections of the Project, the Work or witness point on the date scheduled therefor, Contractor may proceed with such inspection or witness point in Owner's or Owner's designee(s)'s absenceProject Right of Way undertaken by Contractor. No inspection performed or failed to be performed by Owner Concessionaire, VDOT or Owner's designee(s) hereunder the Independent Engineer, or any recommendation from Concessionaire, VDOT or the Independent Engineer in connection therewith, shall be construed as a waiver of any of Contractor's ’s obligations hereunder or be construed as an approval or acceptance of any Work hereunder and shall not relieve Contractor of independent responsibility for performance of the Services. In addition, Work hereunder or for any acts or omissions of the Contractor's design professionals or other Subcontractors engaged by Contractor shall secure for Owner and its designees to perform the inspection rights set forth in Section 2.1.13 hereofWork.

Owner and Owner's designee(s(and, commencing with the Financial Closing Date, the Independent Engineer) shall be given at least five (5) days' advance notice (or, if despite Contractor's use of reasonable efforts only a shorter period of advance notice is available under the circumstances, as much advance notice as is so available) of, and shall have the option of being present at, all inspections and witness points off the Facility Site to be as specified in the Quality Assurance Plan, and, in the event that the progress and quality of the work is not proceeding in accordance with this Agreement and the Design Documents, shall be entitled to make recommendations to Contractor for the purpose of remedying such deficiencies. In the event that Owner (or Owner's designee(sthe Independent Engineer, if applicable) fails to be present for such inspection or witness point on the date scheduled therefor, Contractor may proceed with such inspection or witness point in Owner's (or Owner's designee(s)'s the Independent Engineer's) absence. No inspection performed or failed to be performed by Owner (or Owner's designee(sthe Independent Engineer) hereunder shall be construed as a waiver of any of Contractor's obligations hereunder or be construed as an approval or acceptance of any of the Services. In addition, Contractor shall secure for Owner and its designees the Independent Engineer the inspection rights set forth in Section 2.1.13 hereof.
