Common use of Installation Waiver Clause in Contracts

Installation Waiver. Company will waive the one-time installation charges associated with the implementation of Services within the 48 contiguous States of the U.S. provided under this Agreement except for the following services: (i) eDSL, (ii) VPN, (iii) Internet Dedicated OC3, OC12, OC48, Gig-E, (iv) PTT / third party services (including International Access and Company International), (v) Data Center, (vi) Paging, (vii) Managed Services, (viii) CPE, (ix) Enhanced Call Routing, (x) Local Disaster Recovery, (xi) Audio, Video and Net Conferencing, (xii) Voice over IP Services, (xiii) Security Services, (xiv) Non-Listing/Non-Published Service, (xv) Telecommunications Service Priority, and (xvi) Services provided by Company incumbent local exchange carriers (“ILECs”) or by Cellco Partnership and its affiliates d/b/a Company Wireless. Usage charges, monthly recurring charges, expedite charges, change charges, surcharges, charges for an unlisted or non-published number, any charges imposed by third parties (including access, egress, jack, or wiring charges), taxes or tax-like surcharges, or other Governmental Charges will not be waived.

Installation Waiver. Notwithstanding anything to the contrary in the 4th Amendment, the Agreement, the Private IP Service Attachment, PIP SLA or the Site Services Attachment, Company will agrees to waive the one-time installation charges associated with for the implementation of Services within the 48 contiguous States states of the U.S. provided under this Agreement except for the following services4th Amendment. Except as specified in the preceding sentence with respect to the Services which are subject to the 4th Amendment, Company will not waive any installation charges for: (i) eDSL, (ii) VPN, (iii) Internet Dedicated OC3, OC12, OC48, Gig-E, (iv) PTT / third party services (including International Access and the Company International), (v) Data Center, (vi) Paging, (vii) Managed Services, (viii) CPE, (ix) Enhanced Call Routing, (x) Local Disaster Recovery, (xi) Audio, Video and Net Conferencing, (xii) Voice over IP Services, (xiii) Security Services, (xiv) Non-Listing/Non-Published Service, (xv) Telecommunications Service Priority, and (xvi) Services provided by the Company incumbent local exchange carriers (“ILECs”) or by Cellco Partnership and its affiliates d/b/a the Company Wireless. Promotions: ON THE NETWORK V CROSS CONNECT PROMOTION ON THE NETWORK V LIT BUILDING ACCESS PROMOTION OPTION NO. 53190705 (rev Mar 10, Amendment 18) Initial Term: 24 months Commencing on the 13th Amendment Effective Date, the Term will start anew and continue for a period of 12 months.

Toll Free Surcharge: The Company will waive the monthly recurring charges for Dedicated Access Line (DAL) and Common Business Line (CBL) Toll Free service.

Installation Waiver. In the event that a specific Service Attachment contains an installation waiver, Company shall apply such installation waiver first. In the event that a specific Service Attachment does not cover all installation charges, Customer shall be eligible to receive all installation waivers in this section. Notwithstanding the foregoing, Company will waive the one-time installation charges associated with the implementation of Services within the 48 contiguous States of the U.S. provided under this Agreement Agreement; except for the following services: (i) eDSL, (ii) VPN, (iii) Internet Dedicated OC3, OC12, OC48, Gig-E, (iv) PTT / third party services (including International Access and Company International), (v) Data Center, (vi) Paging, (vii) Managed Services, (viii) CPE, (ix) Contact Center Services (ICR-I) (x) Enhanced Call Routing, (xxi) Local Disaster Recovery, (xi) Audio, Video Video, and Net Conferencing, (xiixiii) Voice over IP Services, (xiiixiv) Security Services, (xivxv) Non-Listing/Non-Published Service, (xvxvi) Telecommunications Service Priority, and (xvixvii) Services provided by Company incumbent local exchange carriers (“ILECs”) or by Cellco Partnership and its affiliates d/b/a Company Wireless. If this Agreement is terminated prior to the completion of the Term, Company may debit Customer’s account pursuant to the standard Tariff Guide monthly recurring charges for switched and dedicated Toll-Free numbers.

Company Com[any will waive the one-time installation charges associated with the implementation of Services within the 48 contiguous States of the U.S. provided under this Agreement except for the following services: (i) eDSL, (iieDSL,(ii) VPN, (iii) Internet Dedicated OC3, OC12, OC48, Gig-E, (iv) PTT / I third party services (including International international Access and Company InternationalCom[any international), (v) Data Center, (vi) Paging, (vii) Managed Services, (viii) CPE, (ix) Enhanced Call Routing, (x) Local Disaster Recovery, (xi) Audio, Video Video, and Net Conferencing, (xii) Voice over IP Services, (xiii) Security Services, (xiv) Non-Listing/Non-Published NonPublished Service, (xv) Telecommunications Service Priority, and (xvi) Services provided by Company Com[any incumbent local exchange carriers (“ILECs”"I LECs") or by Cellco Partnership and its affiliates d/b/a Company Com[any Wireless. Usage charges, monthly recurring charges, expedite charges, change charges, surcharges, charges for an unlisted or non-published number, any charges imposed by third parties (including access, egress, jack, or wiring charges), taxes or tax-like surcharges, or other Governmental Charges will not be waived. 2. Expedite Fee Waiver. Any expedite charge incurred by Customer for which Company does not meet or exceed the expedited due date will be credited to Customer via a written amendment to this Agreement.

Access: The Company will waive the Customer’s monthly recurring Access Coordination and Central Office Connection Charges.

Usage charges, monthly recurring charges, expedite charges, change charges, surcharges, charges for an unlisted or non-published number, any charges imposed by third parties (including access, egress, jack, or wiring charges), taxes or tax-like surcharges, or other Governmental Charges will not be waived. Inbound Toll Free Service Group Charges: The Company will waive the monthly for DAL and CBL terminations. If this Agreement is terminated prior to the completion of the Term, Company may debit Customer’s account pursuant to the standard Tariff Guide monthly recurring charges for switched and dedicated Toll-Free numbers.

Qualifying Condition: Customer must have billed at least $20,000 in conferencing usage with all vendors combined in the month immediately preceding the 4th Amendment Effective Date.

Company will waive the one-time installation charges associated with the implementation of Services within the 48 contiguous States of the U.S. provided under this Agreement except for the following services: (i) eDSL, (ii) VPN, (iii) Internet Dedicated OC3, OC12, OC48, Gig-E, (iv) PTT / third party services (including International Access and Company Verizon International), (v) Data Center, (vi) Paging, (vii) Managed Services, (viii) CPE, (ix) Enhanced Call Routing, (x) Local Disaster Long Distance Recovery, (xi) Audio, Video and Net Conferencing, (xii) Voice over IP Services, (xiii) Security Services, (xiv) Non-Listing/Non-Published Service, (xv) Telecommunications Service Priority, and (xvi) Services provided by Company Verizon incumbent local exchange carriers (“ILECs”) or by Cellco Partnership and its affiliates d/b/a Company Verizon Wireless. Usage charges, monthly recurring charges, expedite charges, change charges, surcharges, charges for an unlisted or non-published number, any charges imposed by third parties (including access, egress, jack, or wiring charges), taxes or tax-like surcharges, or other Governmental Charges will not be waived..
