Common use of INSTRUCTOR ASSIGNMENT Clause in Contracts

INSTRUCTOR ASSIGNMENT. SECTION 1. The administration, employees who have received an administrators certificate from the State Department of Education which is currently valid and/or who is employed primarily in an administrative capacity in Unified School District #464, will endeavor to eliminate instances in which teachers or long term substitutes are assigned classes in subjects which they lack adequate preparation. The professional interests of the teacher will be observed insofar as possible with respect to assignment. In unusual situations a non-certified teacher may be hired but only according to KSDE rules and procedures. SECTION 2. The teacher will be notified at the earliest possible date if any changes in either teacher or building assignment previously agreed upon become necessary due to unforeseen circumstances. SECTION 3. Extra duty assignments, for which a pay scale is not provided in the Extra Duty Pay Schedule (Appendix C), are considered part of each teacher's normal work load. The building principal has the responsibility for assigning these extra duties in a fair and equitable distribution to all the staff. SECTION 4. It is the Board of Education’s responsibility, through the Superintendent and administrative staff, to determine the composition of the professional teaching staff and to implement and maintain the educational needs of the district. When the Board of Education determines that a reduction in the teaching staff is necessary, due to decreasing enrollment, limited financial resources, changes in educational programs, or other circumstances, the following steps will be utilized. Any responsibilities of the Board under this Article will be delegated to the Superintendent of Schools. The intent of this District is to use normal attrition of staff (in the form of resignations, retirement, or leave of absences) as the first means of achieving a reduction in professional staff. However, in certain cases, normal attrition may not be sufficient to achieve the necessary reduction of professional staff. In the event that further reduction of professional staff is necessary, it shall be accomplished as provided in this section. Procedure: For purposes of considering reduction of professional staff, all professional employees of the District will be assigned to either the elementary level (Pre-kindergarten through fifth grade), middle level (sixth grade through eighth), or the high school level (ninth grade through the twelfth). Professional employees will be further assigned to a grade-level or subject area. After determining which level or levels require a reduction of professional staff, and normal attrition has been exhausted for reduction, the following ordered factors will be considered by the Superintendent and the Board of Education in making such reductions as are determined to be necessary:  Licensure,  Probationary status  Professional evaluations,  Highest level of education,  Advanced degrees in subject matter or field, and  Employment seniority in the District. Any professional employee who has not been offered employment as a result of reduction of the professional employee staff shall be considered for reemployment if a vacancy exists for which the professional employee would qualify. Professional employees who may be eligible for reemployment are required to notify the District of their current address. The Superintendent will recommend to the Board reinstatement of any professional employee he/she deems qualified and able to serve the best interests of the District. The Board will consider reemployment of any professional employee for a period of one year from the date of nonrenewal. A position eliminated due to a reduction in force will not be opened for the following school year.
