Common use of Instruments in Writing Clause in Contracts

Instruments in Writing. All actions which may be taken and all powers that may be exercised by the Warrantholders at a meeting held as provided in this Article 7 may also be taken and exercised by Warrantholders entitled to acquire at least 75% of the aggregate number of Common Shares which may be acquired pursuant to all the then outstanding Warrants by an instrument in writing signed in one or more counterparts by such Warrantholders in person or by attorney duly appointed in writing, provided that such instrument was submitted to all the Warrantholders for their prior consideration, and the expression "extraordinary resolution" when used in this Indenture shall include an instrument so signed.

Instruments in Writing. All actions which may be taken and all powers that may be exercised by the Warrantholders at a meeting held as provided in this Article 7 may also be taken and exercised by Warrantholders entitled to acquire at least 75% sixty-six and two-third percent (66⅔%) of the aggregate number of Common Shares which may be acquired pursuant to all the then outstanding Warrants by an instrument in writing signed in one or more counterparts by such Warrantholders in person or by attorney duly appointed in writing, provided that such instrument was submitted to all the Warrantholders for their prior consideration, and the expression "extraordinary resolution" “Extraordinary Resolution” when used in this Indenture shall include an instrument so signed.signed.‌‌‌

All actions which may be taken and all powers that may be exercised by the Registered Warrantholders at a meeting held as provided in this Article 7 may also be taken and exercised by Registered Warrantholders entitled to acquire purchase at least 7566 2/3% of the aggregate number of Common Warrant Shares which may be acquired pursuant to all the then outstanding Warrants by an instrument in writing signed in one or more counterparts by such Registered Warrantholders in person or by attorney duly appointed in writing, provided that such instrument was submitted to all the Warrantholders for their prior consideration, and the expression "extraordinary resolution" “Extraordinary Resolution” when used in this Indenture shall include an instrument so signed.
