Common use of INSURANCE CLAUSE Clause in Contracts

INSURANCE CLAUSE. 11.1 The Event Organiser at Its own cost must take out appropriate and suitable insurance to the minimum value of R20 000 000.00 (Twenty Million Rand) against any claim for damages or losses, which may occur to a third party or third party's property in consequence of or arising out of the Event, which shall include: a) Loss or damages suffered by TKZN and I or the employee(s) of TKZN and I or any other third party by reason of error, omission or neglect occurring or committed In connection with the conduct of the Event; b) Loss or damages suffered by TKZN and I or the employee of TKZN, and I or any third party arising from error, neglect or omission amounting to breach of duty In connection with the obligations and the Event, for which the Event Organiser shall be responsible and legally liable; c) Liability for death or Injury to any third party arising from error, neglect, act or omission amounting to breach of duty in connection with the Event or this agreement for which the Event Organiser Is responsible and legally liable; d) All and any loss or damage suffered by a patron of the Event arising from attendance at the Event or associated with the Event; 11.2 The underwriter of the pollcy shall be an insurance company registered in terms of the Company Law of the Republic of South Africa and acceptable to TKZN. The Event Organiser shall lodge a copy of the policy with TKZN on signature of this Agreement.
