INSURANCE REQUIREMENTS FOR NONPUBLIC SCHOOLS AFFILIATED. WITH A RESIDENTIAL TREATMENT FACILITY (“RTC”) A. Commercial General Liability including both bodily injury and property damage, with limits as follows: $3,000,000 per occurrence $6,000,000 general aggregate The policy shall be endorsed to name the LEA and the Board of Education as named additional insured and shall provide specifically that any insurance carried by the LEA which may be applicable to any claims or loss shall be deemed excess and the RTC’s insurance primary despite any conflicting provisions in the RTC’s policy. Coverage shall be maintained with no Self-Insured Retention above $100,000 without the prior written approval of the LEA. B. Workers’ Compensation Insurance in accordance with provisions of the California Labor Code adequate to protect the RTC from claims that may arise from its operations pursuant the Workers’ Compensation ACT (Statutory Coverage). The Workers’ Compensation Insurance coverage must also include Employers Liability coverage with limits of $1,000,000/$1,000,000/$1,000,000. C. Commercial Auto Liability coverage with limits of $1,000,000 Combined Single Limit per occurrence if the RTC does not operate a student bus service. If the RTC provides student bus services, the required coverage limit is $5,000,000 combined single limit per occurrence. D. Fidelity Bond or Crime Coverage shall be maintained by the RTC to cover all employees who process or otherwise have responsibility for RTC funds, supplies, equipment or other assets. Minimum amount of overage shall be $250,000 per occurrence, with no self-insured retention.

Sexual Molestation and Abuse Coverage, unless that coverage is afforded elsewhere in the Commercial General Liability or Professional liability policy by endorsement, with minimum limits of $3,000,000 per occurrence and $6,000,000 general aggregate. If LEA or CONTRACTOR determines that a change in insurance coverage obligations under this section is necessary, either party may reopen negotiations to modify the insurance obligations.
