Insurances. 27.1 Without limiting the liability of the Supplier/Service Provider under this Agreement, the Supplier/Service Provider shall take out insurance in respect of all risks for which it is prudent for the Supplier/Service Provider to insure against, including any liability it may have as a result of its activities under this Agreement for theft, destruction, death or injury to any person and damage to property. The level of insurance will be kept under review by Transnet, on an annual basis, to ensure its adequacy, provided that any variation to the level of such insurance shall be entirely at the discretion of the Supplier/Service Provider. 27.2 The Supplier/Service Provider shall arrange insurance with reputable insurers and will produce to Transnet evidence of the existence of the policies on an annual basis within 30 [thirty] calendar days after date of policy renewals. 27.3 Subject to clause 27.4 below, if the Supplier/Service Provider fails to effect adequate insurance under this clause 27, it shall notify Transnet in writing as soon as it becomes aware of the reduction or inadequate cover and Transnet may arrange or purchase such insurance on behalf of the Supplier/Service Provider. The Supplier/Service Provider shall promptly reimburse Transnet for any premiums paid provided such insurance protects the Supplier/Service Provider’s liability. 18.5 Should any claim exceed the amount of limits covered by the Service provider’s Liability Insurance Policy(s) the Service Provider shall be liable for the difference between the actual amount claimed and the amount insured. Likewise it is recorded that in the event that the annual limit of cover is exceeded the Service provider shall be fully liable for any claims above those applicable limits.

Insurances. 27.1 25.1 Without limiting the liability of the Supplier/Service Provider Supplier under this Agreement, the Supplier/Service Provider Supplier shall take out insurance in respect of all risks for which it is prudent for the Supplier/Service Provider Supplier to insure against, including any liability it may have as a result of its activities under this Agreement for theft, destruction, death or injury to any person and damage to property. The level of insurance will be kept under review by Transnet, on an annual basis, to ensure its adequacy, provided that any variation to the level of such insurance shall be entirely at the discretion of the Supplier/Service Provider.
27.2 25.2 The Supplier/Service Provider Supplier shall arrange insurance with reputable insurers and will produce to Transnet evidence of the existence of the policies on an annual basis within 30 [thirty] calendar days after date of policy renewals.
27.3 25.3 Subject to clause 27.4 25.4 below, if the Supplier/Service Provider Supplier fails to effect adequate insurance under this clause 2725, it shall notify Transnet in writing as soon as it becomes aware of the reduction or inadequate cover and Transnet may arrange or purchase such insurance on behalf of the Supplier/Service Provider. The Supplier/Service Provider Supplier shall promptly reimburse Transnet for any premiums paid provided such insurance protects the Supplier/Service Provider’s liability. Transnet assumes no responsibility for such insurance being adequate to protect all of the Supplier/Service Provider’s liability.
27.4 25.4 In the event that the Supplier/Service Provider Supplier receives written notice from its insurers advising of the termination of its insurance cover referred to in clause 27.1 25.1 above or if the insurance ceases to be available upon commercially reasonable terms, the Supplier/Service Provider Supplier shall immediately notify Transnet in writing of such termination and/or unavailability, whereafter either the Supplier/Service Provider Supplier or Transnet may terminate this Agreement on giving the other Party not less than 30 [thirty] calendar days prior written notice to that effect.

16.5 Should any claim exceed the amount of limits covered by the Service provider’s Liability Insurance Policy(s) the Service Provider shall be liable for the difference between the actual amount claimed and the amount insured. Likewise it is recorded that in the event that the annual limit of cover is exceeded the Service provider shall be fully liable for any claims above those applicable limits.

27.3 15.3 Subject to clause 27.4 15.4 below, if the Supplier/Service Provider fails to effect adequate insurance under this clause 2715, it shall notify Transnet TNPA in writing as soon as it becomes aware of the reduction or inadequate cover and Transnet TNPA may arrange or purchase such insurance on behalf of the Supplier/Service Providerinsurance. The Supplier/Service Provider shall promptly reimburse Transnet TNPA for any premiums paid provided such insurance protects the Supplier/Service Provider’s liability. 27.4 Service Provider shall provide Passenger liability cover to protect their business if their driver is liable in terms of law for injury of passengers. The requirements should be minimum of R1 million per incident. The insurance cannot be beyond the value proposed.
27.5 Service Provider to provide Transnet with a copy of a valid/active insurance cover i.e. General Liability/Public liability or Passenger Liability insurance, either by supplying a copy of the insurance policy or a letter from an underwriter. Confirming policy exists and that the maximum amount claimable is R1m per incident.
27.6 In the event that the Supplier/Service Provider receives written notice from its insurers advising of the termination of its insurance cover referred to in clause 27.1 above or if the insurance ceases to be available upon commercially reasonable terms, the Supplier/Service Provider shall immediately notify Transnet in writing of such termination and/or unavailability, whereafter either the Supplier/Service Provider or Transnet may terminate this Agreement on giving the other Party not less than 30 [thirty] calendar days prior written notice to that effect.

17.5 Should any claim exceed the amount of limits covered by the Service provider’s Liability Insurance Policy(s) the Service Provider shall be liable for the difference between the actual amount claimed and the amount insured. Likewise it is recorded that in the event that the annual limit of cover is exceeded the Service provider shall be fully liable for any claims above those applicable limits.

Insurances. 27.1 17.1 Without limiting the liability of the Supplier/Service Provider under this Agreement, the Supplier/Service Provider shall take out insurance for Public liability and in respect of all risks for which it is prudent for the Supplier/Service Provider to insure against, including any liability it may have as a result of its activities under this Agreement for theft, destruction, death or injury to any person and damage to property. The level of insurance will be kept under review by Transnet, on an annual basis, to ensure its adequacy, provided that any variation to the level of such insurance shall be entirely at the discretion of the Supplier/Service Provider.
27.2 17.2 The Supplier/Service Provider shall arrange insurance with reputable insurers and will produce to Transnet evidence of the existence of the policies at the inception of the contract and on an annual basis within 30 [thirty] calendar days after date of policy renewals. The policy certificates must be in the name of the Service Provider and the Public liability policy must have a minimum insurance cover limit of R5,000,000.00( Five million rand)per claim without limiting the number of claims.
27.3 17.3 Subject to clause 27.4 17.4 below, if the Supplier/Service Provider fails to effect adequate insurance under this clause 2715, it shall notify Transnet in writing as soon as it becomes aware of the reduction or inadequate cover and Transnet may arrange or purchase such insurance on behalf of the Supplier/Service Providerinsurance. The Supplier/Service Provider shall promptly reimburse Transnet for any premiums paid provided such insurance protects the Supplier/Service Provider’s liability. Transnet assumes no responsibility for such insurance being adequate to protect all of the Supplier/Service Provider’s liability.
27.4 17.4 In the event that the Supplier/Service Provider receives written notice from its insurers advising of the termination of its insurance cover referred to in clause 27.1 17.1 above or if the insurance ceases to be available upon commercially reasonable terms, the Supplier/Service Provider shall immediately notify Transnet in writing of such termination and/or unavailability, whereafter either the Supplier/Service Provider or Transnet may terminate this Agreement on giving the other Party not less than 30 [thirty] calendar days prior written notice to that effect.
17.5 Should any claim exceed the amount of limits covered by the Service provider’s Liability Insurance Policy(s) the Service Provider shall be liable for the difference between the actual amount claimed and the amount insured. Likewise it is recorded that in the event that the annual limit of cover is exceeded the Service provider shall be fully liable for any claims above those applicable limits.

27.4 17.4 In the event that the Supplier/Service Provider receives written notice from its insurers advising of the termination of its insurance cover referred to in clause 27.1 17.1 above or if the insurance ceases to be available upon commercially reasonable terms, the Supplier/Service Provider shall immediately notify Transnet in writing of such termination and/or unavailability, whereafter either the Supplier/Service Provider or Transnet may terminate this Agreement on giving the other Party not less than 30 [thirty] calendar days prior written notice to that effect.
17.5 Should any claim exceed the amount of limits covered by the Service provider’s Liability Insurance Policy(s) the Service Provider shall be liable for the difference between the actual amount claimed and the amount insured. Likewise it is recorded that in the event that the annual limit of cover is exceeded the Service provider shall be fully liable for any claims above those applicable limits.
