Interconnection of Third Party Facilities to Customer System. 5.4.1 Customer will provide advance written notice to National Grid prior to the proposed interconnection to the Customer System of any: (1) new Generator ; (2) 10% increase or more in the capacity of an existing Generator connected to the Customer System ; or (3) peak load increases of 10% or greater over the peak load stated in Exhibit A. Such written notice shall be provided within 30 Calendar Days of Customer receiving an interconnection or service request or notice of a proposed increase in Generator capacity. 5.4.2 National Grid or the NYISO, as applicable, will have the right to perform an Interconnection Study in order to determine the extent of the impact of a proposed interconnection or increase in Generator capacity covered by Section 5.4.1 on the National Grid Transmission System. National Grid or the NYISO shall perform any such studies pursuant to any applicable NYISO requirements. If upgrades to the National Grid Transmission System are required as a result of the proposed interconnection or increase in Generator capacity, such upgrades will be performed by National Grid or a third party designated by National Grid at the expense of either the Customer, the owner of the Generator, or the owner of the load connecting to the Customer System and such responsible party shall reimburse National Grid for all actual costs and expenses of constructing, operating, and maintaining the upgrades. The party responsible for such costs shall be identified and agreed to prior to National Grid commencing any work with respect to such upgrades.
