Interim Service. The Executive shall serve as the Interim Chief Executive Officer of the Company commencing immediately and continuing through February 29, 2012 (the “Interim Period”).
Interim Service. If there is a pre-empted delay in your Fibre order (e.g. due to BM approval delays, insufficient fibre capacity or congested MDF room), you can request for paid interim ADSL or Enterprise Web services through your AM. We will waive the ETC when you terminate the interim services after using your Fibre Service. You are, however, required to terminate the interim services via our Business Helpdesk once your Fibre Service is active.
Interim Service. 20.6.1 To the extent that Service Commencement is delayed beyond the Planned Service Commencement Date, then without prejudice to Clause 20.5.1-
Interim Service. Where either party entitled to serve a New Customer pursuant to Section 2.2 above believes that the extension of its facilities to such New Customer would not be appropriate or compatible with its existing operational requirements but would be compatible with its future plans, the party may, in its discretion, request the other party to provide service to the New Customer on an interim basis. Such request shall be made in writing and the other party shall promptly notify the requesting party if it will accept or decline the request. If such request is accepted, the party providing interim service shall be deemed to do so only on behalf of the requesting party, who shall remain entitled to serve the New Customer to the same extent as if it had provided service in the first instance. At such time as the requesting party elects to begin providing service directly to the New Customer, after reasonable written notice to the other party, such other party shall cease providing interim service and, thereafter, service shall be furnished to the New Customer in accordance with Sections 2.1 and 2.2 above.
Interim Service. Upon entering this Agreement, and during vacancy periods, any Electrical and Water services, not covered by the HOA shall revert over to HI Pacific Property Management. During this time, HI Pacific Property Management shall monitor all activity and proceed to pay the HECO and BOARD OF WATER SUPPLY invoices on behalf of the Owner. Once the property is rented, any outstanding balance will then be deducted from the Owner’s Distribution (Rent Income – 10% commission). A mandated $20 Interim Fee is assessed by HECO each time Electrical Interim service is processed. This Fee will be the responsibility of the Property Owner. Should the Owner exit the Property Management Program, any/all Interim Services will be terminated and Owner will be responsible to take over services. *GAS interim services are excluded.
Interim Service. From time to time during the period from Closing until August 31, 2000 and within 2 days after a request therefor is made (which request shall be made in consultation with Purchaser and shall indicate the purposes for which the advance shall be used), Purchaser shall pay to Seller cash advances for Seller's direct operating, staffing and out-of-pocket expenses in connection with Purchaser's having access to the Seller's South Triad, Englewood, Colorado equipment, employees (which shall include approximately 44 transition employees) and facilities from July 31, 2000 through August 31, 2000 and cash advances aggregating $120,000 for Seller's direct operating and out-of-pocket expenses in connection with Purchaser's having access to the Seller's Pasadena, California equipment and facilities from July 31, 2000 through August 31, 2000 ("Service Fees"). Purchaser shall not be obligated to fund the full amounts described in the preceding sentence on the Closing Date and instead shall advance Seller such amounts a reasonable time (but at least two business days) in advance of the time at which it will actually incur such operating, staffing and out-of-pocket expenses. On the Closing Date, Purchaser shall advance Service Fees for Seller's real estate leases, operating and equipment leases, payroll expenses and other expenses to be incurred on or before August 11, 2000 and shall subsequently advance amounts in accordance with this subsection 7(b)(v). Seller shall maintain such facilities, staffing and equipment during such time so that the Purchaser can effectively continue to both operate and transition the Business to other locations during such period. Purchaser shall not be directly responsible for any amounts owed with respect to any real or personal property leases. The actual amount of the Service Fees incurred by Seller directly relating to Purchaser's access will be reconciled with the advance by Purchaser paying any additional amounts owing or Seller refunding any overpayment of Service Fees on or before September 30, 2000. The Parties shall cooperate in good faith with respect to the transitioning of those of Seller's employees that Purchaser desires to hire on a full-time basis (it being understood that Seller shall terminate any such employee prior to Purchaser's hiring such employee).
Interim Service. Shipper agrees that, in the event Transporter places Certificate 1 Segment in-service before the Project reaches PEPL-Audrain, but with interconnections to Natural Gas Pipeline Company of America (Natural) in Jefferson County, Nebraska, Northern Natural Gas Company (NNG) in Jefferson County, Nebraska and ANR Pipeline Company (ANR) in Xxxxx County, Missouri, Shipper shall pay the Certificate 1 Segment Interim Rates set forth on Appendix A until PEPL-Audrain is available, during the term of the FTSA executed in connection with Certificate 1 Segment. Shipper further agrees that, in the event Transporter places Certificate 2 Segment in-service before the Project reaches the Lebanon Hub, but with interconnections to Natural in Xxxxx County, Illinois, Trunkline Gas Company (Trunkline) in Xxxxxxx County, Illinois, Midwestern Gas Transmission Company (Midwestern) in Xxxxx County, Illinois and PEPL in Xxxxxx County, Indiana, Shipper shall pay the Certificate 2 Segment Interim Rates set forth on Appendix A until the Lebanon Hub points are available, during the term of the FTSA executed in connection with Certificate 2 Segment. In the event that Transporter is unable, in aggregate, to provide firm service to Shipper equal to Shipper’s MDQ for Interim Service, Transporter shall reduce Shipper’s reservation charges for the quantity of Shipper’s MDQ that Transporter is unable to provide to Shipper. Furthermore, in the event that the capacity of the delivery points made available under Interim Service is less than the total MDQ of the applicable Certificate Segment, then Shipper’s MDQ shall be reduced, during the period for which interim Service is offered, by the proportion that the available capacity of the delivery points made available bears to the total MDQ of the Project. For Certificate 1 Segment Interim Service and Certificate 2 Segment Interim Service, respectively, if such Interim Service extends beyond twelve months, then as an incentive for Transporter to place the PEPL-Audrain point or the Lebanon Hub points in-service as expeditiously as possible, Shipper’s Interim Rates shall be prospectively reduced by fifty percent (50%) until full service is available.
Interim Service as a failure for purposes of determining whether or not there has been a failure on a "Confirmed Basis," as defined in the Transponder Service Agreement. The initial Transponder assignment for the PAS-3 Capacity shall be Transponder #[ ]*. The parties may agree, in writing, to increase the amount of PAS-3 Capacity provided to Customer in lieu of Customer's allocated capacity on PAS-5. In such event, the PAS-3 Capacity shall be provided in accordance with a set of revised specifications which PanAmSat shall provide to Customer upon executing an amendment to such effect.
Interim Service. There shall be no interim water service for additional Water Users authorized by Paragraph 14 (b) until all necessary modifications to the Service Connection and Service Meter are accepted by Golden and any required modification to the Service Line is completed. Following acceptance of the Service Connection, water service shall be billed in the manner provided in paragraph 6 above.
Interim Service. 8A.17.1 Where the Contractor is required, pursuant to clause 8A.2.2 to provide an Interim Service then the Contractor shall until the Planned Waste Management Facility Operation Date of the Newhaven ERP (“Interim Service Period”) perform the Interim Service and the Councils shall pay the Interim Service Payment in accordance with the provisions of Schedule 12 provided that where the Contractor has not used All Reasonable Endeavours to Acquire or All Reasonable Endeavours to Obtain Planning Permission the Councils shall only be obliged to pay such amount as is fair, reasonable and proportionate having regard to the extent to which the need for the Interim Service was caused by the Contractor’s failure to use All Reasonable Endeavours to Acquire or All Reasonable Endeavours to Obtain Planning Permission and the Parties shall seek to agree such amount and failing such agreement the matter may be referred by the Lead Authority or the Contractor to be determined pursuant to clause 70 (Disputes Resolution).
