Transit Service is the delivery of certain traffic between Carrier and a third party ILEC, CLEC or CMRS provider by Frontier over a separate trunk group between Carrier and Frontier where appropriate trunks exist between Carrier and third party through Frontier’s tandem. The following traffic types will be delivered: (I) Local Traffic originated from Carrier to such third-party and (ii) Local Traffic originated from such third-party to Frontier’s tandem and terminated to Carrier.

Transit Service. 5.1 Carrier shall compensate Frontier for Transit Service as follows: Carrier shall pay Frontier a Transit Service charge as set forth in Attachment 7, Pricing for Transit Service originated by Carrier to any third party carrier, or terminated to Carrier from a third-party Incumbent Local Exchange Carrier. 5.1.1 Each Party acknowledges that Frontier does not have any responsibility to pay any charges for termination of any transit traffic originating from a non-Party’s network.
Transit Service. 7.3.1 Each Party shall exercise all reasonable efforts to enter into a reciprocal local traffic exchange arrangement (either via written agreement or mutual tariffs) with any wireless carrier, ITC, CLEC, or other LEC to which it sends, or from which it receives, local traffic that transits the other Party’s facilities over Traffic Exchange Trunks. If either Party fails to enter into such an arrangement as quickly as commercially reasonable following the Effective Date and to provide written notification of such Agreement, including the relevant rates therein, to the other Party, but continues to utilize the other Party’s Transit Service for the exchange of local traffic with such wireless carrier, ITC, CLEC, or other LEC, then the Party utilizing the Transit Service shall, in addition to paying the rate set forth in Exhibit A for said Transit Service, pay the other Party any charges or costs such terminating third party carrier imposes or levies on the other Party for the delivery or termination of such Traffic, including any switched access charges, plus all reasonable expenses incurred by the other Party in delivering or terminating such Traffic and/or resulting from the utilizing Party’s failure to secure said reciprocal local traffic exchange arrangement. Each Party will, upon request, provide the other Party with all reasonable cooperation and assistance in obtaining such arrangements. In addition, neither Party shall take any actions to prevent the other Party from entering into a direct and reciprocal local traffic exchange arrangement (either via written agreement or mutual tariffs) with any wireless carrier, ITC, CLEC, or other LEC to which it sends, or from which it receives, local traffic that does not utilize the Transit Service of the first Party. The Parties agree to work cooperatively in appropriate industry fora to promote the adoption of reasonable industry guidelines relating to Transit Traffic. 7.3.2 Transit Traffic that is originated by an ITC or wireless carrier shall be settled in accordance with the terms of an appropriate IntraLATA Telecommunications Services Settlement Agreement between the Parties substantially in the form appended hereto as Exhibit D. Transit Service. 7.3.1 MFS shall exercise all reasonable efforts to enter into a reciprocal local traffic exchange arrangement (either via written agreement or mutual tariffs) with any wireless carrier, ITC, CLEC, or other LEC to which it sends, or from which it receives, local traffic that transits BA facilities over Traffic Exchange Trunks. If MFS fails to enter into such an arrangement as quickly as commercially reasonable following the Effective Date and to provide copies thereof to BA, but continues to utilize BA's Transit Service for the exchange of local traffic with such wireless carrier, ITC, CLEC, or other LEC, MFS shall, in addition to paying the rate set forth in Exhibit A for said Transit Service, pay BA any charges or costs such terminating third party carrier imposes or levies on BA for the delivery or termination of such Traffic, including any switched access charges, plus all reasonable expenses incurred by ---- BA in delivering or terminating such Traffic and/or resulting from MFS's failure to secure said reciprocal local traffic exchange arrangement. BA will, upon request, provide MFS with all reasonable cooperation and assistance in obtaining such arrangements. The Parties agree to work cooperatively in appropriate industry fora to promote the adoption of reasonable industry guidelines relating to Transit Traffic. 7.3.2 Meet-Point Billing compensation arrangements as described in subsection 6.3 shall be utilized for compensation for the joint handling of Toll Traffic. 7.3.3 BA expects that most networks involved in Transit Traffic will deliver each call to each involved network with CCS and the appropriate Transactional Capabilities Application Part ("TCAP") message to facilitate full interoperability of those services supported by BA and billing functions. In all cases, each Party shall follow the Exchange Message Record ("EMR") standard and exchange records between the Parties and with the terminating carrier to facilitate the billing process to the originating network. 7.3.4 Transit Traffic shall be routed over the Traffic Exchange Trunks described in Section 5 above.

Transit Service. 12.1 As used in this Section, Transit Service is Telephone Exchange Service traffic that originates on Carrier's network, and is transported through Frontier’s Tandem to the subtending End Office or its equivalent of another carrier (CLEC, ILEC other than Frontier, Commercial Mobile Radio Service (CMRS) carrier, or other LEC (“Other Carrier”), when neither the originating nor terminating customer is a Customer of Frontier. For the avoidance of any doubt, under no circumstances shall Frontier be required to transit traffic through a Frontier Tandem to an End Office that does not have local Interconnection facilities and direct trunks to that particular Frontier Tandem. Switched Exchange Access Service traffic is not Transit Service. 12.1.1 If Carrier provides service using an NPA-NXX assigned to a rate center where Frontier provides extended area service or an applicable regulatory authority approved optional calling plan, and Carrier chooses to indirectly interconnect by using the tandem switching facilities of a third party, Frontier will have no obligation to route and rate traffic to Carrier’s NPA-NXX as an EAS call or pursuant to an optional calling plan unless Carrier has established a trunking and transiting arrangement for this traffic with Frontier and the other telecommunications carrier(s) utilizing the trunk and providing transiting service for the traffic. 12.2 Transit Service provides Carrier with the transport of Transit Service as provided below. 12.3 Transit Service may be routed over the Interconnection Trunks described in Sections 2 through 6 of this Attachment. Carrier shall deliver each Transit Service call to Frontier’s Tandem with CCS and the appropriate Transactional Capabilities Application Part (“TCAP”) message to facilitate full interoperability of CLASS Features and billing functions. 12.3.1 Carrier may use Transit Service only for traffic that originates on Carrier’s network and only to send traffic to an Other Carrier with whom Carrier has a reciprocal traffic exchange arrangement (either via written agreement or mutual tariffs) that provides for the Other Carrier, to terminate or complete traffic originated by Carrier and to xxxx Xxxxxxx, and not to bill Frontier, for such traffic. Xxxxxxx agrees not to use Frontier’s Transit Service to send traffic to an Other Carrier with whom Xxxxxxx does not have such a reciprocal traffic exchange arrangement or to send traffic that does not originate on Carrier’s network. 12.4 Carrier sha...
