Internet Access Guarantee. Except in the event of Facilities Maintenance (subject to the notice requirements of Section 1.5), Customer use of a single physical connection and Force Majeure conditions, QTS shall have the contracted Internet access available for the Customer to transmit information to, and receive information from the Internet *** of the time during the Term of this Addendum (“Internet Access Guarantee”). Customer acknowledges that incremental usage in excess of the Committed Data Rate is subject to available bandwidth of the QTS network.
