INTRODUCTION AND SCOPE OF AGREEMENT. 1.1 Pursuant to Sections 251(a) and (b) of the Telecommunications Act of 1996 (“Act”), this Agreement sets forth the terms and conditions for the interconnection of TCAL’s network to TDS TELECOM's network, compensation for the transport and termination of telecommunications traffic between TDS TELECOM and TCAL, and the provision of ancillary functions by TDS TELECOM and TCAL. 1.2 The Parties acknowledge and agree that by entering into and performing in accordance with this Agreement, the Parties have not waived any applicable exemptions that are provided by or available under the Act, including but not limited to those described in 47 USC 251(f), or under state law.
