Investigation Phase. Any faculty member asked to participate in an investigatory interview is entitled, upon request, to have an Association Representative present during such interview. If circumstances warrant, the accused faculty member may be placed on suspension of duties for up to five (5) workdays without pay with approval of the Executive Director of Human Resources where it is necessary to carry out an effective investigation. Suspension without pay for up to five (5) days by the Executive Director of Human Resources may occur and be implemented by the Executive Director of Human Resources only in instances where a prima facie case exists against a faculty member. In no instance shall a faculty member be placed on unpaid leave in excess of five (5) scheduled workdays during the Investigation Phase unless the additional time is caused by an outside investigatory agency. Upon request, the faculty member may use Personal Leave to credit the unpaid suspension time to the extent they have Personal Leave available. If the President decides that formal corrective action is warranted, then the suspension during the Investigation Phase will be credited when serving a formal disciplinary suspension and the affected individual shall be made whole for the difference between the assessed formal corrective suspension and the number of days they had been suspended without pay. If the President gives no corrective action, then the time served without pay during the investigation, including any Personal Leave used, will be given back to the accused faculty member and that individual shall be made whole. If the faculty member is removed from their position for just cause, there shall be no compensation for the time off during the investigation.

Investigation Phase. Consultant shall complete data gathering that was initiated in Phase I, coordinate with utility companies, perform site surveying and any necessary environmental investigation.
Investigation Phase. Consultant shall visit the project site, initiate and hold project meetings as may be necessary to develop the design and preliminary sketches of the contemplated project. The Task Assignment shall specify the required number of visits necessary for the Consultant to design/develop construction plans and technical specification. The Consultant shall confer with the project manager to ascertain the number of site/project meetings. The number of site visits and/or project meetings shall depend upon the complexity of the project.

If a Phase I Report discloses any violations or adverse environmental conditions, or reports a reasonable suspicion thereof, then Acquiror may promptly obtain, at the expense of the Company and Acquiror, shared equally, a Phase II environmental report with respect to any affected property which report shall contain an estimate of the cost of any remediation or other follow-up work that may be necessary to address those violations or conditions in accordance with applicable laws and regulations (each a “Phase II Report,” and collectively referred to with the associated Phase I Report, an “Environmental Report”). Acquiror shall have no duty to act upon any information produced by an Environmental Report for the benefit of the Company, any Acquired Subsidiary or any other Person, but shall provide such information to the Company upon the Company’s request.

  • Litigation and Investigations Promptly after (i) the occurrence thereof, notice of the institution of or any material adverse development in any material action, suit or proceeding or any governmental investigation or any arbitration, before any court or arbitrator or any governmental or administrative body, agency or official, against any Consolidated Company, or any material property of any thereof, or (ii) actual knowledge thereof, notice of the threat of any such action, suit, proceeding, investigation or arbitration;
