Common use of Investment of Capital Contributions Clause in Contracts

Investment of Capital Contributions. The Capital Contributions of the Members shall be invested by the Managing Member in demand, money market or time deposits, obligations, securities, investments or other instruments constituting cash equivalents, until such time as such funds shall be used by the Managing Member for Company purposes. Such investments shall be made by the Managing Member for the benefit of the Company.

Investment of Capital Contributions. The Capital Contributions of the Members shall be invested by the Managing Member Managers in demand, money market or time deposits, obligations, securities, investments or other instruments constituting cash equivalents, until such time as such funds shall be used by the Managing Member Manager for Company purposes. Such investments shall be made by the Managing Member Managers for the benefit of the Company. At the request of any Member, in connection with any Capital Contribution, the Managers shall determine, or cause to be determined, whether the Company would be treated as an investment company, within the meaning of Code Section 721, as a result of such Capital Contribution.
