Common use of Investment of Merger Fund Clause in Contracts

Investment of Merger Fund. The Paying Agent shall invest any cash in the Merger Fund as directed by Parent or, after the Effective Time, the Surviving Corporation. Any interest and other income resulting from such investments shall be paid to the Surviving Corporation or Parent, as Parent directs.

Investment of Merger Fund. The Paying Agent shall invest any cash included in the Merger Fund Fund, as directed by Parent, on a daily basis; provided that in the case of any losses incurred as a result of such investments, Parent or, after shall take all actions necessary to ensure that the Effective Time, the Surviving CorporationMerger Fund includes at all times cash sufficient to satisfy Parent's obligations under this Article IV. Any interest and other income resulting from such investments shall be paid to the Surviving Corporation or Parent, as Parent directs.
