Common use of Invitation for Competitive Clause in Contracts

Invitation for Competitive. Bid Quotes. Promptly and in any event before the close of business on the same Business Day of receipt of a Competitive Bid Quote Request that is not rejected pursuant to Section 2.16(b), the Administrative Agent shall send to each of the Lenders by telecopy an Invitation for Competitive Bid Quotes substantially in the form of Exhibit C-2 hereto, which shall constitute an invitation by the Borrower to each Lender to submit Competitive Bid Quotes offering to make the Competitive Bid Loans to which such Competitive Bid Quote Request relates in accordance with this Section 2.16.

Promptly and in any event before the close of business on the same Business Banking Day of receipt of a Competitive Bid Quote Request that is not rejected pursuant to Section 2.16(b2.4(b), the Administrative Agent shall send to each of the Lenders by telecopy or electronic mail an Invitation for Competitive Bid Quotes substantially in the form of Exhibit C-2 hereto, which shall constitute an invitation by the Borrower to each Lender to submit Competitive Bid Quotes offering to make the Competitive Bid Loans to which such Competitive Bid Quote Request relates in accordance with this Section 2.162.4.

Promptly and in any event before the close of business on the same Business Day of receipt of a Competitive Bid Quote Request that is not rejected pursuant to Section 2.16(b2.22(a), the Administrative Agent shall send to each of the Lenders by telecopy an Invitation for Competitive Bid Quotes substantially in the form of Exhibit C-2 I-2 hereto, which shall constitute an invitation by the Borrower to each Lender to submit Competitive Bid Quotes offering to make the Competitive Bid Loans to which such Competitive Bid Quote Request relates in accordance with this Section 2.162.22.

Promptly and in any event before the close of business on the same Business Day of receipt of a Competitive Bid Quote Request that is not rejected pursuant to Section 2.16(b2.1(B), the Administrative Agent shall send to each of the Lenders by telecopy facsimile an Invitation for Competitive Bid Quotes substantially in the form of Exhibit C-2 M hereto, which shall constitute an invitation by the Borrower Company to each Lender to submit Competitive Bid Quotes offering to make the Competitive Bid Loans to which such Competitive Bid Quote Request relates in accordance with this Section 2.162.1.

Promptly and in any event before the close of business on the same Business Day of receipt of a Competitive Bid Quote Request that is not rejected pursuant to Section 2.16(b)2.3.2, the Administrative Agent shall send to each of the Lenders Banks by telecopy an Invitation for Competitive Bid Quotes substantially in the form of Exhibit C-2 "D" hereto, which shall constitute an invitation by the Borrower to each Lender Bank to submit Competitive Bid Quotes offering to make the Competitive Bid Loans to which such Competitive Bid Quote Request relates in accordance with this Section 2.162.3.

Promptly and in any event before the close of business on the same Business Day of receipt delivery of a Competitive Bid Quote Request that is not rejected pursuant to Section 2.16(b)2.3.2, the Administrative Competitive Bid Agent shall send to each of the Lenders (except as otherwise provided in Section 2.3.10) by telex or telecopy an Invitation for Competitive Bid Quotes substantially in the form of Exhibit C-2 D hereto, which shall constitute an invitation by the Borrower to each such Lender to submit Competitive Bid Quotes offering to make the Competitive Bid Loans to which such Competitive Bid Quote Request relates in accordance with this Section 2.162.3. 2.3.4.
