Joint and Several Liability of Lessee. From and after the Effective Date, Emeritus Corporation, a Washington Corporation ("Emeritus") shall (i) be jointly and severally liable for all of the obligations of the “Lessee” under the Master Lease, as hereby amended, and (ii) assume jointly and severally with Current Lessee, all obligations of “Lessee” arising under the Master Lease, as hereby amended, on, prior to or after the Effective Date.
Joint and Several Liability of Lessee. From and after the Effective Date, Pinellas LLC, Ocala West LLC, CY-Fair LP, Friendswood LP, New Port Xxxxxx LLC, Lakeland LLC, St. Augustine LLC, Ocala East LLC, and Venice LLC shall (i) be jointly and severally liable for all of the obligations of the "Lessee" under the Master Lease, as hereby amended, and (ii) assume jointly and severally with Original Lessee, all obligations of "Lessee" arising under the Master Lease on, prior to or after the Effective Date.
Joint and Several Liability of Lessee. From and after the Effective Date, Park Place Lessee (i) shall be jointly and severally liable for all of the obligations of the "Lessee" under the Lease, as hereby amended, and (ii) hereby assumes jointly and severally with those other Persons comprising the "Lessee" under the Lease all obligations of "Lessee" arising under the Lease, as hereby amended, whether occurring or accruing on, prior to or after the Effective Date.
Joint and Several Liability of Lessee. Effective as of the Effective Date, each of Kindred Hospitals and THCW hereby joins as a “Lessee” under the Lease, as hereby amended, and assumes, jointly and severally with Current Lessee, all of the rights, benefits, privileges, duties, covenants, liabilities and obligations of the “Lessee” under the Lease, as hereby amended, whether arising on, prior to or after the Effective Date.
Joint and Several Liability of Lessee. From and after the Effective Date, Fox Run LLC shall (i) be jointly and severally liable for all of the obligations of the "Lessee" under the Master Lease, as hereby amended, and (ii) assume jointly and severally with Current Lessee, all obligations of "Lessee" arising under the Master Lease, as hereby amended, on, prior to or after the Effective Date.
Joint and Several Liability of Lessee. From and after the Effective Date, Chestnut Hill LLC shall (i) be jointly and severally liable for all of the obligations of the "Lessee" under the Master Lease, as hereby amended, and (ii) assume jointly and severally with Current Lessee, all obligations of "Lessee" arising under the Master Lease, as hereby amended, on, prior to or after the Effective Date.
Joint and Several Liability of Lessee. From and after the Effective Date, Wekiwa Springs LLC, Oak Park LLC, Lookout Pointe LLC, Oak Ridge LLC and Oviedo LLC (each as defined on Appendix A attached hereto) shall (i) be jointly and severally liable for all of the obligations of the "Lessee" under the Master Lease, as hereby amended, and (ii) assume jointly and severally with Current Lessee, all obligations of "Lessee" arising under the Master Lease, as hereby amended, on, prior to or after the Effective Date.
Joint and Several Liability of Lessee. From and after the Effective Date, Summerville 9 shall (i) be jointly and severally liable for all of the obligations of the "Lessee" under the Master Lease, as hereby amended, and (ii) assume jointly and severally with Current Lessee, all obligations of "Lessee" arising under the Master Lease, as hereby amended, on, prior to or after the Effective Date.
Joint and Several Liability of Lessee. From and after the Effective Date, Carrollwood LLC and Gainesville LLC shall {i) be jointly and severally liable for all of the obligations of the "Lessee" under the Master Lease, as hereby amended, and (ii) assume jointly and severally with Current Lessee, all obligations of "Lessee" arising under the Master Lease, as hereby amended, on, prior to or after the Effective Date.
Joint and Several Liability of Lessee. From and after the Effective Date, Lakeland Hills LP and Xxxxxx XX shall (i) be jointly and severally liable for all of the obligations of the "Lessee" under the Master Lease, as hereby amended, and (ii) assume jointly and severally with Current Lessee, all obligations of "Lessee" arising under the Master Lease, as hereby amended, on, prior to or after the Effective Date.
