Except as reflected on the as-built ALTA/ACSM survey delivered by Borrower pursuant to Section 5.1(ff), to Borrower’s knowledge, none of the Collateral at the Project Site includes improved real estate that is located in an area that has been identified by the Director of the Federal Emergency Management Agency as an area having special flood hazards and in which flood insurance has been made available under the National Flood Insurance Act of 1968, as amended.
