Common use of Landlord Not Responsible for Acts of Others Clause in Contracts

Landlord Not Responsible for Acts of Others. Landlord shall not be responsible or liable to Tenant, or those claiming by, through or under Tenant, for any loss or damage to their person or property resulting from the acts or omissions of persons occupying space adjoining or adjacent to the Premises or connected to the Premises or any other part of the Shopping Center or Resort caused by but not limited to events such as breaking or falling of electrical cables and wires, the breaking, bursting, stoppage or leaking of water, gas, sewer or steam pipes.

Landlord Not Responsible for Acts of Others. Landlord shall not be responsible or liable to Tenant, or to those claiming byclaiming, through or under Tenant, for any loss or damage to their person or property resulting which may result from (a) the acts or omissions of persons occupying space adjoining or adjacent to the Premises or connected to the Premises or in any other part of the Shopping Center Center, or Resort caused by but not limited to events such as breaking their agents, employees, contractors or falling of electrical cables and wires, invitees or (b) from the breaking, bursting, stoppage or leaking of electrical cable and wires, or water, gas, sewer or steam pipes. Tenant acknowledges that its use of the Premises and Shopping Center is at its own risk.

Landlord Not Responsible for Acts of Others. Landlord or its agents shall not be responsible or liable to Tenant, or those claiming by, through or under Tenant, for any loss of or damage to their person any property of Tenant, its agents or invitees, by theft or otherwise, nor for any injury or damage to persons or property resulting from the acts or omissions any cause of persons occupying space adjoining or adjacent to the Premises or connected to the Premises or any other part of the Shopping Center or Resort caused by but not limited to events such as breaking or falling of electrical cables and wireswhatsoever nature, including without limitation the breaking, bursting, stoppage or leaking of electrical cable and wires, or water, gas, sewer or steam pipes, unless caused by or due to the negligence of Landlord, their agents, servants or employees.
