Common use of Landlord's Covenant of Quiet Enjoyment Clause in Contracts

Landlord's Covenant of Quiet Enjoyment. Landlord hereby covenants to Concessionaire that Landlord has title, subject to the Tidelands Trust, to the Premises, free of all claims, liens and encumbrances. Upon Concessionaire paying the Base Rent, Percentage Rent and other amounts payable hereunder and observing and performing all of the covenants, conditions and provisions on Concessionaire's part to be observed and performed hereunder, Concessionaire shall peaceably hold and quietly enjoy the Premises for the entire term hereof without hindrance, molestation or interruption by Landlord or any party claiming through or under Landlord.

Landlord hereby covenants to Concessionaire Tenant that Landlord has title, subject good and marketable fee simple title to the Tidelands Trust, to the PremisesSite, free and clear of all claims, liens and encumbrancesencumbrances except the Tidelands Grant restrictions. Upon Concessionaire Tenant paying the Base Rent, Percentage Rent and other amounts payable hereunder and observing and performing all of the covenants, conditions and provisions on Concessionaire's Tenant’s part to be observed and performed hereunder, Concessionaire Tenant shall peaceably hold and quietly enjoy the Premises Site for the entire term hereof without hindrance, molestation or interruption by Landlord or any party claiming through or under Landlord.
