Common use of Landlord’s Election to Repair Clause in Contracts

Landlord’s Election to Repair. If (a) Landlord estimates that repairs to the Premises cannot be completed within ninety (90) days after the commencement thereof, or (b) insurance proceeds are insufficient for rebuilding the Premises or the holder of any Superior Interests requires the insurance proceeds to be applied to payment of debt, or (c) any material uninsured damage to the Building occurs (whether or not the Premises are affected), then in any such event Landlord may elect to terminate this Lease or to repair the Premises and/or the portion of the Building necessary for Tenant’s use and occupancy of the Premises.
