IF A PARTY FAILS TO WITHDRAW A REQUEST FOR A JURY TRIAL IN A LAWSUIT ARISING OUT OF THIS AGREEMENT AFTER WRITTEN NOTICE BY ANY OF THE OTHER PARTY PARTIES OF VIOLATION OF THIS SECTION, THE PARTY MAKING THE REQUEST FOR JURY TRIAL SHALL BE LIABLE FOR THE REASONABLE ATTORNEYS' ’ FEES AND COSTS OF THE OTHER PARTY PARTIES IN CONTESTING THE REQUEST FOR JURY TRIAL, AND SUCH AMOUNTS SHALL BE AWARDED BY THE COURT IN ADJUDICATING THE MOTION. Prior to the filing of any litigation relating to this Agreement, the Parties will participate in a non- binding mediation with each party to bear its own attorneys’ fees and costs; however, each party shall pay equally on a one-third (1/3) basis its share of the mediator’s fees and, if applicable, any pre-approved cost(s) incurred by the mediator.
