Common use of LAWS, LICENSES, PERMITS AND REGULATIONS Clause in Contracts

LAWS, LICENSES, PERMITS AND REGULATIONS. Contractor and County agree to comply with all State laws and regulations that pertain to construction, health and safety, labor, minimum wage, fair employment practices, equal opportunity, and all other matters applicable to Contractor and County, their sub-grantees, contractors, or subcontractors, and their work. Contractor shall possess and maintain all necessary licenses, permits, certificates and credentials required by the laws of the United States, the State of California, County of Merced and all other appropriate governmental agencies, including any certification and credentials required by County. Failure to maintain the licenses, permits, certificates, and credentials shall be deemed a breach of this Agreement and constitutes grounds for the termination of this Agreement by County. The general prevailing wage rates shall apply to this Agreement in accordance with the latest wage scale determination as set forth by the Department of Industrial Relations, Sections 1770 to 1781 inclusive and Sections 1817 and 1818 inclusive of the Labor Code of the State of California and local laws thereto applicable. The Board of Supervisors of Merced County, in the manner required by law, has ascertained the general prevailing rate of wages and also the hourly rates for Saturday, Sunday, holiday and overtime work, in the locality where this work is to be performed, for each craft, classification and type of xxxxxxx or mechanic needed to perform the work of this project, and has published this wage scale in accordance with Sections 1773 and 1773.2 of the said Labor Code, which scale will become part of the Agreement. Copies of the prevailing rate of per diem wages are on file with the Department of Public Works, located at 000 Xxxxxx Xxxxxx Xxxx Jr. Way, Merced, CA, 95341, and shall be made available to any interested party on request. A copy of this wage scale may also be obtained from the office of the Director of Industrial Relations, State of California, or xxxx://xxx.xxx.xx.xxx/DLSR/PWD/mer.xls.
