Common use of Layoff Process (Part-Time Clause in Contracts

Layoff Process (Part-Time. a) In the event of a layoff of part-time employee(s), the Employer will lay-off part- time employees within the affected classification(s) in the reverse order of their bargaining unit seniority provided that there remain on the job employees who have the ability and qualifications to perform the work, subject to the following: b) A part-time employee who is subject to layoff shall have the right to: i) accept the lay-off; or ii) displace a part-time employee who has lesser bargaining unit seniority in the same classification or in an identical or lower paying classification provided that the part-time employee originally subject to layoff is qualified for and can perform the duties of the classification with a maximum of three (3) shifts of orientation. In determining the ability of an employee to perform the work for the purposes above, the Employer shall not act in an arbitrary fashion. The decision of the part-time employee to choose (i), or (ii) above shall be given in writing to the Administrator within three (3) calendar days (excluding Saturday, Sunday and Holidays) following the notification of lay-off. Employees failing to do so will be deemed to have accepted the lay-off.
