Legal Remedies for Disputes. Any dispute, question, claim, or other matter arising out of or relating to this Agreement (each, a “Dispute”) shall be resolved by the escalation procedure set out below in Section 10.3 (Three-Tiered Dispute Resolution). However, no Party shall be precluded from initiating a proceeding in a court of competent jurisdiction for the purposes of obtaining any emergency or provisional remedy to protect its rights that may be necessary and that are not otherwise available under this Agreement, including temporary and preliminary injunctive relief and restraining orders.
