Common use of Legality of Deduction Clause in Contracts

Legality of Deduction. The parties agree that neither the employees nor the Union shall have a claim against the Employer for errors in the processing of deductions, unless a claim of error is made to the Employer in writing within sixty (60) days after the date such error is claimed to have occurred. If it is found an error was made, it will be corrected at the next pay period that the Union dues deduction would normally be made by deducting the proper amount. Notwithstanding the provisions of this Article or this Agreement all provisions shall be subject to applicable and subordinate to federal and state law and rules of the State Employment Relations Board.
